1. Agreement to Terms
By downloading, installing, or using VoiceSnap (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
VoiceSnap is operated by Quantum Creations Studio (“we,” “us,” or “our”), located in Winnipeg, Manitoba, Canada.
2. Description of Service
VoiceSnap is a voice recording and transcription application that provides:
- Audio recording (up to 90 minutes per recording)
- On-device speech-to-text transcription
- AI-powered features including summaries, notes, flashcards, quizzes, and more
- Cloud-based AI processing for premium features
3. Eligibility
You must be at least 13 years old to use this App. If you are under 18, you must have permission from a parent or guardian to use this App and make purchases.
4. Account and Purchases
4.1 Purchases Required
VoiceSnap requires a purchase to access the App’s features. We offer:
- Credit Packs: One-time purchases of 1 credit ($0.99 USD) or 3 credits ($1.99 USD)
- Monthly Subscription: $4.99 USD per month (includes 5 credits per month)
- Annual Subscription: $29.99 USD per year (includes 5 credits per month)
4.2 Credit System
- 1 credit = 1 AI feature use on any recording
- AI Chat feature: 1 credit = 5 questions
- Recording and transcription are unlimited and do not require credits
- Purchased credits (credit packs) never expire
- Subscription credits reset monthly and do not roll over to the next month
4.3 Payment Processing
All payments are processed through Apple’s App Store. By making a purchase, you also agree to Apple’s Terms of Service.
4.4 Subscriptions
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your Apple ID Account Settings
- Any unused portion of a free trial period will be forfeited when you purchase a subscription
4.5 Refunds
Refund requests are handled by Apple according to their refund policies. We do not have the ability to process refunds directly. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.
5. Acceptable Use
You agree NOT to use VoiceSnap to:
- Record conversations without the consent of all parties where required by law
- Violate any local, state, national, or international law or regulation
- Record, transcribe, or process content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Infringe upon the intellectual property rights of others
- Attempt to reverse engineer, decompile, or disassemble the App
- Circumvent or attempt to circumvent any security features
- Use the App for any commercial purpose without our written consent
- Transmit viruses, malware, or other malicious code
- Overload, impair, or disrupt the App or its servers
6. Recording Consent and Legal Compliance
6.1 Your Responsibility
You are solely responsible for ensuring that your use of VoiceSnap complies with all applicable laws regarding recording conversations. Many jurisdictions require consent from one or all parties before recording a conversation.
6.2 One-Party vs. Two-Party Consent
- Some jurisdictions allow recording with only one party’s consent (the person recording)
- Other jurisdictions require all parties to consent to being recorded
- It is YOUR responsibility to know and comply with the laws in your jurisdiction
6.3 No Legal Advice
We do not provide legal advice. If you are unsure about the legality of recording in your situation, consult with a qualified attorney.
7. Intellectual Property
7.1 Our Intellectual Property
The App, including its design, features, code, graphics, and content, is owned by Quantum Creations Studio and is protected by copyright, trademark, and other intellectual property laws.
7.2 Your Content
You retain ownership of any audio recordings and transcripts you create using the App. By using our AI features, you grant us a limited license to process your content through our servers solely for the purpose of providing the requested AI features.
7.3 AI-Generated Content
Content generated by our AI features (summaries, notes, flashcards, etc.) is provided for your personal use. You may use this generated content for any lawful purpose.
8. AI Features and Third-Party Services
8.1 AI Processing
Our AI features are powered by third-party AI services (Anthropic Claude). When you use AI features, your transcript content is sent to these services for processing.
8.2 No Guarantee of Accuracy
AI-generated content is provided “as is” without any warranty of accuracy, completeness, or fitness for any particular purpose. You should review and verify all AI-generated content before relying on it.
8.3 Third-Party Terms
By using our AI features, you also agree to comply with the terms of service of our AI providers.
9. Privacy
Your use of VoiceSnap is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
10. Disclaimers
10.1 “As Is” Service
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 No Guarantee of Availability
We do not guarantee that the App will be available at all times or that it will be free from errors, bugs, or interruptions.
10.3 Transcription Accuracy
On-device transcription accuracy depends on audio quality, background noise, accents, and other factors. We do not guarantee the accuracy of any transcription.
10.4 AI Limitations
AI-generated content may contain errors, inaccuracies, or inappropriate content. Always review AI-generated content before use.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUANTUM CREATIONS STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or business opportunities
- Personal injury or property damage
- Any damages arising from your use or inability to use the App
- Any damages arising from unauthorized access to your recordings or data
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Quantum Creations Studio, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your violation of any third party’s rights
13. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by:
- Posting the updated Terms in the App
- Updating the “Last Updated” date at the top of these Terms
Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
14. Termination
14.1 By You
You may stop using the App at any time. To cancel a subscription, use your Apple ID Account Settings.
14.2 By Us
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms or suspected fraudulent activity.
14.3 Effect of Termination
Upon termination, your right to use the App ceases immediately. Any credits you have purchased are non-refundable upon termination.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of the Province of Manitoba, Canada, without regard to conflict of law principles.
15.2 Dispute Resolution
Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration in Winnipeg, Manitoba, Canada.
15.3 Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Quantum Creations Studio regarding your use of VoiceSnap and supersede any prior agreements.
