Please read these Terms of Service (“Terms”) carefully before using the WingMate mobile application (the “App”) operated by Quantum Creations Studio (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using WingMate, you confirm that you are at least 18 years old and agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the App.
2. Description of Service
WingMate is an AI-powered dating coach application that helps users generate personalized reply suggestions for dating app conversations. Users can upload screenshots of their dating app chats or profiles, and our AI will analyze the content to suggest engaging, appropriate responses.
3. User Accounts and Credits
The App uses a credit-based system:
- New users receive 3 free credits
- Additional credits can be purchased through in-app purchases
- Subscriptions provide monthly credit allocations
- Credits are non-refundable and non-transferable
- Unused credits from one-time purchases do not expire
- Subscription credits reset each billing cycle and do not roll over
4. In-App Purchases and Subscriptions
- All purchases are processed through Apple’s App Store
- Subscription payments are charged to your Apple ID account
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- You can manage and cancel subscriptions in your Apple ID account settings
- Prices are subject to change with notice
- Refunds are handled according to Apple’s refund policy
5. Acceptable Use
You agree NOT to:
- Upload screenshots containing illegal content, explicit material, or content involving minors
- Use the App to harass, stalk, or harm others
- Attempt to reverse engineer, hack, or compromise the App’s security
- Use the generated replies for spam, fraud, or deceptive purposes
- Share your account or credits with others
- Use automated systems or bots to access the service
- Violate any applicable laws or third-party rights
6. Content and Intellectual Property
- You retain ownership of any screenshots you upload
- By using the App, you grant us a limited license to process your images solely for the purpose of providing the service
- The App, including its design, features, and AI technology, is owned by Quantum Creations Studio and protected by intellectual property laws
- Generated reply suggestions are provided for your personal use only
7. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not guarantee that:
- The AI-generated suggestions will be appropriate for every situation
- The suggestions will result in successful romantic connections
- The App will be uninterrupted, error-free, or secure
- The results will meet your expectations
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUANTUM CREATIONS STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of relationships or romantic opportunities
- Emotional distress from dating interactions
- Any outcomes resulting from the use of suggested replies
- Data loss or unauthorized access to your device
Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Quantum Creations Studio and its affiliates from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.
10. Termination
We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately, and any unused credits may be forfeited.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or by other means. Your continued use of the App after changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Manitoba, Canada.
